Legal basis for the processing of personal data

 

Categories of personal data collected in the VIS

  • alphanumeric data on the applicant and on visas requested, issued, refused, annulled, revoked or extended
  • referred to in points (1) to (4) of Article 9 and Articles 10 to 14 VIS Regulation;
  • photograph referred to in point (5) of Article 9 VIS Regulation;
  • fingerprint data referred to in point (6) of Article 9 VIS Regulation;
  • links to other applications referred to points (3) and (4) of Article 8 VIS Regulation.

Data subject rights in VIS

  1. The right to be informed by the responsible Member State on the identity and contact details of the data controller in charge of the processing of personal data within that Member State, purpose for which their personal data will be processed within the VIS, the categories of persons to whom the data may be transmitted (recipients), the data retention period. In addition, the data subject shall be informed about the fact that the collection of their personal data under VIS is mandatory for the examination of their application, while Member States shall also inform he/she about the existence of his/her right to access the data, request correction or deletion including the right to receive information on the procedures for exercising those rights
  2. The right to access the personal data related to them which have been recorded in the VIS.
  3. The right to correct inaccurate data.
  4. The right to delete unlawfully stored data.

Excercise of data subject rights

The data subject may exercise the above mentioned rights with the controller (MFA SR)

  • electronically by sending an e-mail to ochranaudajov@mzv.sk, while electronic exercise of rights applies in particular to cases where personal data have been provided electronically and communication with the data subject took place in electronic form;,
  • in writing by registered letter to the address of the controller MFA SR as stated above.

 

Right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic (Úrad na ochranu osobných údajov Slovenskej republiky, hereinafter referred to as SK DPA):

Data subject shall have the right to bring an action or a complaint before the Office for PDP SK when MFA SR (controller) refuses the right of access to or the right of correction or deletion of data relating to him/her.
